Rivus User Agreement

1. Terms and definitions

Operator / Administration — the Sole Proprietor Rivus, managing the Service.

User — any individual visiting the Website and/or using the Platform functionality.

Guest — a User without an active membership who has access to the public part of the Platform.

Member — a User with an active Rivus Club subscription (membership).

Seller / Vendor — a Platform partner that lists goods/offers and processes orders for its own goods.

Content — any information on the Platform (texts, photos, product cards, descriptions, curations, interface elements, etc.).

Account — the User’s account on the Platform.

3. General terms of use

3.1. The Rivus Platform is a closed digital platform and club that brings together trusted brands, goods, and expertise. The Service is not a “mass marketplace” and uses a curated selection approach.

3.2. Certain sections and features may be available only to Club Members with an active membership.

3.3. The Operator may change the structure, design, functionality, and operating rules of the Platform without prior notice, provided that this does not violate the User’s rights under applicable law.

3.4. The Service may operate in MVP mode: certain features may not be available in all scenarios or may be temporarily limited.

4. Registration and account

4.1. To access the personal account and closed sections, the User must create an Account.

4.2. Registration and login may be performed using a phone number and/or email address with a password and/or one-time confirmation codes (OTP), depending on implementation.

4.3. The User agrees to provide accurate information, keep it up to date, and not transfer access to their account to third parties.

4.4. The User is responsible for all actions performed in their account.

4.5. The Operator may restrict access to an account in case of suspected unauthorized access, fraud, violation of the Agreement, or legal requirements.

5. Rivus Club membership (subscription)

5.1. Membership provides access to the closed sections of the Platform, including viewing prices and extended information, as well as the ability to place an order if the feature is available.

5.2. The procedure for purchasing and paying for membership is determined by the terms posted on the membership (pricing) page and/or during payment.

5.3. Membership statuses may include, for example: Active / Expired / Paused / Blocked.

5.4. The Operator may suspend or terminate membership access if the User violates this Agreement or in other cases provided by law.

6. Products, sellers, and orders

6.1. Products on the Platform are listed by Sellers (Vendors) who have passed moderation.

6.2. The Platform provides an interface for exploring products and placing an order. Order fulfillment for products of a specific Seller is performed by that Seller and/or authorized persons.

6.3. To place an order, the User provides the required data (full name, phone, city, address, comment).

6.4. Availability, timeframes, delivery/pickup, returns, and warranties are determined by the laws of the Republic of Kazakhstan and Sellers’ policies.

6.5. The Operator may restrict order placement for Users without an active membership.

7. Conduct rules and restrictions

The User is prohibited from:

7.1. Using the Website for illegal purposes.

7.2. Attempting to access closed sections without authorization (bypassing the paywall), hacking, parsing, large-scale data collection, or interfering with the Website operation.

7.3. Posting or transmitting materials that infringe third-party rights, contain illegal content, or malware.

7.4. Impersonating another person or using someone else’s contact details.

7.5. Disrupting the Service, including DDoS attacks, password guessing, and exploiting vulnerabilities.

In case of rule violations, the Operator may restrict or block the User’s access.

8. Intellectual property

8.1. All rights to the Website, source code, design, structure, texts, curations, the Rivus brand, logos, and other elements belong to the Operator and/or rightsholders.

8.2. The User receives a limited right to use the Service solely for personal non-commercial purposes (unless otherwise agreed).

8.3. It is prohibited to copy, distribute, modify, publish, sell, or otherwise use the Website materials without written permission of the rightsholder, except as expressly permitted by law.

8.4. Sellers’ content (descriptions, product photos, branding) may belong to the respective Sellers; its use is governed by the rights of the respective rightsholders.

9. Personal data

9.1. Personal data processing is carried out in accordance with the Privacy Policy posted on the Website.

9.2. By using the Service, the User confirms consent to personal data processing for the purposes of providing Platform functionality, fulfilling membership, and placing orders.

10. Liability and disclaimer of warranties

10.1. The Service is provided “as is”. The Operator does not guarantee error-free or uninterrupted operation but takes reasonable measures to maintain functionality.

10.2. The Operator is not liable for:

actions of Sellers, product quality, delivery times, and other order terms determined by the Seller;

User losses caused by providing incorrect data;

Website outages caused by factors beyond the Operator’s control (network issues, providers, payment systems, etc.).

10.3. The Operator may restrict access to the Service during maintenance, high load, or security threats.

11. Handling requests

11.1. The User may contact support regarding the use of the Service and data processing at: r.itakhunova@rivus.kz.

11.2. The Operator reviews requests within a reasonable timeframe depending on the complexity of the request.

12. Changes to the Agreement

12.1. The Operator may amend this Agreement. The current version is published on the Website.

12.2. Continued use of the Service after changes means that the User accepts the new version.

13. Governing law and disputes

13.1. The parties’ relationship is governed by the laws of the Republic of Kazakhstan.

13.2. The parties seek to resolve disputes through negotiations. If not possible, the dispute is resolved in accordance with the procedure established by the laws of the Republic of Kazakhstan.
